zCastle Smart Home Control App

These Terms & Conditions ("Terms") govern your use of the zCastle application ("App"), developed and maintained by Device Cortex, LLC ("we," "us," or "our"). The App is provided as a free application for Android and iOS.
Please read these Terms carefully before using the App.
By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the App and uninstall it from your device.
We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes on devices you own or control, subject to these Terms. This license does not allow you to distribute, sublicense, or make the App available to third parties.
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, DEVICE CORTEX, LLC DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL DEVICE CORTEX, LLC, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR USE, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE APP, WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY.
BECAUSE THE APP IS PROVIDED FREE OF CHARGE, OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATED TO THE APP SHALL NOT EXCEED ZERO DOLLARS ($0.00).

The App is a convenience tool for interfacing with compatible home automation controllers. The App is not a safety or security system. Do not rely on the App for critical safety functions, security monitoring, or any use where failure could result in personal injury, property damage, or other harm. Always maintain independent safety and security measures for your home.
The App connects to and relies on third-party services, including:
We are not responsible for the availability, accuracy, or functionality of third-party services. Changes to or discontinuation of third-party services may affect the App's functionality without notice. Your use of third-party services is subject to their respective terms and conditions.

You agree to comply with all applicable terms and conditions of third-party services used in connection with the App, including Homeseer's terms of service.
The App and all associated content, including but not limited to design, graphics, text, and code, are owned by Device Cortex, LLC and are protected by applicable intellectual property laws. These Terms do not grant you any rights to our trademarks, trade names, or other intellectual property.
We reserve the right to suspend or terminate your access to the App at any time, for any reason, without notice or liability. Upon termination, you must cease all use of the App and uninstall it from your devices. The provisions of these Terms that by their nature should survive termination shall remain in effect.
These Terms shall be governed by and construed in accordance with the laws of the State of Florida, United States, without regard to its conflict of law provisions.
If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect.
We may update these Terms from time to time. Any changes will be posted on this page with an updated effective date. Your continued use of the App after changes are posted constitutes your acceptance of the revised Terms. We encourage you to review this page periodically.
